By accessing or using TalkTree ("Service", "we", "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

TalkTree is a web-based platform that allows users to create, explore, and manage AI-assisted conversations structured as branching trees. The Service includes features such as conversation branching, AI persona selection, branch merging, tree visualization, and Markdown export.

The Service is provided on an "as is" basis. Features, availability, and performance are subject to change without prior notice.

3. User Accounts

You must create an account to access most features of the Service. You are responsible for:

• Providing accurate and complete registration information.
• Maintaining the confidentiality of your account credentials.
• All activity that occurs under your account.

You must be at least 16 years old to use the Service. If you become aware of any unauthorized use of your account, notify us immediately via our contact page.

4. Acceptable Use

You agree not to use the Service to:

• Generate, store, or distribute illegal, harmful, or abusive content.
• Attempt to circumvent rate limits, access controls, or security measures.
• Reverse engineer, scrape, or extract the Service's underlying systems.
• Use automated scripts or bots to interact with the AI outside of the UI.
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
• Transmit viruses, malware, or any other malicious or disruptive code.

We reserve the right to suspend or terminate accounts that violate these rules without prior notice.

5. AI-Generated Content

The Service uses large language models (LLMs) to generate responses. You acknowledge that:

• AI-generated content may be inaccurate, incomplete, or misleading.
• You are solely responsible for verifying and acting on any AI-generated information.
• TalkTree does not guarantee the accuracy, reliability, or fitness of AI-generated content for any particular purpose.
• You own the content you input. AI responses generated through your account are yours to use, subject to these Terms.

6. Intellectual Property

TalkTree and its original content, features, and functionality are owned by TalkTree and protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our prior written consent.

You retain ownership of any content you create and store through the Service. By using the Service, you grant TalkTree a limited, non-exclusive license to process and display your content solely to provide the Service to you.

7. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

8. Payments and Subscriptions

Certain features of the Service may require a paid subscription. All fees are stated in USD and are non-refundable except as required by applicable law. We reserve the right to change pricing with 30 days' notice. Continued use after a price change constitutes acceptance of the new price.

9. Termination

You may delete your account at any time from your account settings. We may suspend or terminate your access to the Service at our discretion, including for violations of these Terms, without prior notice or liability.

Upon termination, your right to use the Service will cease. We may retain certain data as required by law or for legitimate business purposes.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. TalkTree does not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

11. Limitation of Liability

To the maximum extent permitted by applicable law, TalkTree shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of the Service, even if we have been advised of the possibility of such damages.

12. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the effective date at the top of this page and notify you by email or in-app notice. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration or in a court of competent jurisdiction.
